1. Who is responsible for your data
The data controller is DEVEXIS OOD, a limited liability company (OOD) registered in Bulgaria under unified identification code 208747294, with its registered seat at 17 Dimitar Dimov Str., Vinitsa, Primorski District, Varna 9000, Bulgaria. 2. Scope of this policy
This policy covers the Betterly website and waitlist, and the Betterly mobile app and related services. Some features described here apply only once the app is available to you; where a feature is not yet live, the related processing begins when you start using it. It does not cover third-party services that have their own privacy policies (see section 7).
3. Personal data we collect
Depending on how you use Betterly, we collect:
- Waitlist data. Your email address, the campaign/source you came from, and the time you joined.
- Account data. Your name, email address, and authentication identifiers. Passwords and sign-in are handled by our authentication provider; we do not store your password.
- Profile & fitness data. Information you provide to personalize your plans, such as age or date of birth, sex, height, weight, activity level, fitness goals, training experience, available equipment, injuries or physical limitations, dietary preferences, and allergens. Some of this is health-related data — see section 4.
- Activity data. Workouts and meals you log, progress, streaks, and how you interact with plans.
- Device & technical data. Device type, operating system, app version, language, approximate location derived from IP address, identifiers, and diagnostic or crash information.
- Payment data. If you subscribe, our payment processor and/or the app store handles your payment. We receive confirmation and limited billing details (such as plan, status, and the last digits of a card) but not your full card number.
- Communications. Messages you send us (for example, support requests) and your marketing preferences.
4. Health & fitness data (special category)
Some of the profile and activity data above — for example injuries, certain dietary or allergen information, weight, and details that reveal aspects of your physical health — is treated as “special category” data under Article 9 of the GDPR. We process it only to provide the personalization you ask for, and we rely on your explicit consent (Article 9(2)(a)) to do so. You can withdraw that consent at any time (see section 10); withdrawing it does not affect processing carried out before withdrawal, but it may mean we can no longer generate or maintain your personalized plans.
5. How we use your data & legal bases
We use your personal data for the following purposes:
- To run the waitlist and tell you about launch — based on your consent, and our legitimate interest in managing sign-ups.
- To provide the Service (create your account, deliver training and meal plans, save your progress) — to perform our contract with you.
- To personalize plans using health-related data — based on your explicit consent (see section 4).
- To process payments and manage subscriptions — to perform our contract and to comply with tax and accounting obligations.
- To secure, maintain, and improve the Service and analyze usage — based on our legitimate interest in a safe, reliable, and better product.
- To send marketing about Betterly — based on your consent, which you can withdraw at any time (for example, via the unsubscribe link).
- To comply with the law and to establish, exercise, or defend legal claims — based on our legal obligations and legitimate interests.
6. AI personalization & automated processing
Betterly uses algorithms and artificial intelligence to generate training and nutrition plans from the information you provide. This automated processing is used to tailor content to you and does not produce legal effects or similarly significant effects on you. You can adjust your inputs at any time, and you can contact us to ask questions about, or request human review of, a recommendation.
8. International data transfers
Some of our service providers process data outside the European Economic Area (for example, in the United States). Where that happens, we rely on an appropriate safeguard under the GDPR — such as an adequacy decision or the European Commission’s Standard Contractual Clauses — so that your data receives an equivalent level of protection. You can contact us for more information about these safeguards.
9. How long we keep your data
We keep personal data only for as long as necessary for the purposes above:
- Waitlist entries — until launch and our launch announcement, and we then delete remaining entries roughly 90 days afterward (or earlier on request).
- Account, profile & activity data — for as long as your account is active and for a limited period after closure (typically up to 12 months), unless a longer period is required by law.
- Payment & accounting records — for the period required by applicable tax and accounting law.
10. Your rights under the GDPR
Subject to conditions in the law, you have the right to: access your data; correct inaccurate data; erase your data (“right to be forgotten”); restrict or object to processing; receive your data in a portable format; and withdraw consent at any time where we rely on it. To exercise any right, email hello@betterly.fit. We will respond within the time the law allows (normally one month). You will not have to pay a fee unless your request is clearly unfounded or excessive.
If you believe we have not handled your data properly, you can lodge a complaint with the Commission for Personal Data Protection (Комисия за защита на личните данни), 2 Prof. Tsvetan Lazarov Blvd., Sofia 1592, Bulgaria, website https://www.cpdp.bg, or with the supervisory authority in your country of residence.
12. How we protect your data
We use appropriate technical and organizational measures to protect personal data against unauthorized access, loss, or misuse, including encryption in transit, access controls, and use of reputable infrastructure providers. No method of transmission or storage is completely secure, but we work to protect your data and to handle any incident responsibly, including notifying you and the authorities where the law requires.
13. Children
Betterly is not directed to children under 16, and we do not knowingly collect their personal data. If you believe a child has provided us data without appropriate consent, contact us and we will delete it.
14. Third-party links
Our website and app may link to third-party sites or services we do not control. This policy does not apply to them; please review their own privacy policies.
15. Changes to this policy
We may update this policy from time to time. If a change is material, we will provide reasonable notice (for example, by email or in-app). The “Last updated” date above shows when it last changed.
